PAYE Temp Supply – nothing to fear

As a supply agency, have you switched, or are you considering switching, from supplying personal service company (PSC) contractors because of IR35 or client requirements? Putting aside operating your own payroll, which can always be outsourced, there are key compliance requirements which businesses should be aware of. None of these are complicated but may at first glance appear to be daunting. Whilst it is important to follow the requirements under the Conduct of Employment Agencies and Employment Businesses Regulations and the Agency Workers Regulations, the reality is that the alternate regime and related processes can easily be accommodated.

PAYE temps will usually have worker status giving rise to various statutory rights such as under the Working Time Regulations (in particular, with respect to holiday pay), and other potential employment rights depending on the contract used. But these key compliance requirements are manageable. With good knowledge, access to information, compliant documentation and the right support, there is nothing to be fearful of, save change itself. With careful adjustment, margins can remain as before and a new process can replace the old, whilst disposing of the difficulties and consequent risks and liabilities that now exist due to the current IR35 regime, albeit the small business regime for PSCs still remains largely risk free.
