Abolition of compulsory retirement age – an update

Following our article in January’s AZ newsletter, the draft regulations to abolish the default retirement age of 65 have been laid before parliament.

The Regulations will come into force on 6 April 2011. The last ‘notice of intended retirement’ can be given up until 5 April 2011* for employee’s who have attained or will attain the age of 65 by 30 September 2011.

*However, employers should note that notices given between 1 April – 5 April 2011 may be subject to a penalty because an employer will not be providing the minimum 6 months notice required – please refer to the January AZ newsletter article.
